Today’s introductory $97 price applies to the first year of membership. After your first year, you will be charged $97 per year, and your membership will renew automatically.  You can cancel the auto-renewal anytime in your account through the duration of the 365 day period of your membership.

Due to alcohol shipping laws, some wine and liquor costs will vary depending on the shipping location. Wine Chateau Rewards Pass Program

Welcome to the Terms and Conditions ("Terms") for the Rewards Pass shipping membership program (“Rewards Pass”). These Terms are between you and WineChateau.com, and/or its affiliates ("Wine Chateau"), and govern our respective rights and obligations. The Terms, together with the applicable terms and conditions related to any promotional offers provided to you for use with Rewards Pass, constitute the entire agreement between you and WineChateau.com related to Rewards Pass. Please note that your use of the WineChateau.com website, mobile applications, and Rewards Pass membership are also governed by our Terms of Service and Privacy Policy, as well as all other applicable terms, conditions, limitations and requirements on the WineChateau.com website, all of which (as changed over time) are incorporated into these Terms. If you register for Rewards Pass membership, you accept these terms, conditions, limitations and requirements.  Please read these Terms carefully.

Program Benefits

Rewards Pass members are entitled to free standard shipping on all eligible purchases and eligible products within those purchases.  All members receive priority status to ship out of our warehouse.  All members will receive exclusive offers from time to time, through various marketing promotions and targeted Reserve Pass member campaigns.  Priority status is only priority under the Wine Chateau warehouse until the package leaves our facility, and once the order leaves here, it is not under any additional shipping priority. Upon release of allocated items Reserve Pass Members can receive first look status on a case by case product by product basis during those releases. 

Eligibility on Purchases

Free standard shipping is on products that are marked Reserve Pass items on our website WineChateau.com and that are shipped to continental United States addresses, excluding U.S. territories, possessions and protectorates. We may exclude products and specific shipping location addresses at our discretion. Standard shipping is not available in Alaska, Hawaii, or any other state we have marked as a no sale state, so any purchase in a state deemed No Sale State, will be credited back their Reserve Pass membership fee upon a customer initiated request.  All purchasers of the Reserve Pass membership must be 21 years of age living in the continental United States.

Conditions

You must have a WineChateau.com account setup to register for and use The Rewards Pass membership and its benefits. We reserve the right to accept or refuse membership at our discretion. You may not transfer or assign your Rewards Pass membership or any Rewards Pass benefits, including promotion codes for Rewards Pass memberships or benefits, except as allowed in these terms. Changing or combining orders, or changing your shipping address, speed, or preferences might affect the Rewards Pass member eligibility.  

Please note:  We ship our products by ground at our discretion (these options do not correspond to any carrier-branded shipping services);  Our carriers usually do not pick-up or deliver packages on weekends or holidays;  Promo code is valid only on orders placed from the WineChateau.com account that purchased The Rewards Pass program. Code cannot be used on any other Wine Chateau account. In cases of extreme weather where only expedited shipping is available, you will receive a credit for the cost of standard shipping. The Rewards Pass cannot be given as a gift because it is tied to the account of the person purchasing it.  Instead, we recommend a gift certificate or signing up the person you are giving the gift to’s email address and account info if available. Evening, date-specific and by appointment shipments will receive a credit for the cost of standard shipping. We may exclude products with special shipping characteristics such as size, weight, or state lowest price thresholds, at our discretion. Your WineChateau.com Reserve Pass membership does not apply to orders placed through our Corporate Sales team. Rewards Pass members are not permitted to purchase products for the purpose of resale, rental, or to ship to their customers or potential customers using Rewards Pass benefits. From time to time, Wine Chateau.com may choose at its sole discretion to add or remove Rewards Pass membership benefits.

TERMS - CHANGES, TERMINATION AND LIABILITY

Agreement Changes

WineChateau.com may in its discretion change and update these Terms, WineChateau.com's general Terms of Service and Privacy Policy, or any aspect of Rewards Pass membership, without prior notice to you. However, any increase in the membership fee will not apply until your membership is renewed. If you cancel your membership before the effective date, WineChateau.com will continue your access to the remainder of the number of full months remaining in your membership period. This refund option does not apply to any other changes WineChateau.com may make.  If any change is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED MEMBERSHIP AFTER WINECHATEAU.COM CHANGES THESE TERMS, TERMS OF SERVICE, PRIVACY POLICY, OR MEMBERSHIP CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR MEMBERSHIP.

Termination by WineChateau.com

WineChateau.com may terminate your membership at its discretion without notice. If we do so, we will give you a prorated refund based on the number of full months remaining in your membership. However, we will not give any refund for termination related to conduct that WineChateau.com determines, in its discretion, violates these Terms or any applicable law, involves fraud or misuse of this membership program, or is harmful to our interests or another user. WineChateau.com’s failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of its rights.

Title & Ownership

Since vendors own all of the inventory listed online and therefore arrange for transportation of the wine & spirits, WineChateau.com is providing a service to, and acting on behalf of the purchaser. By utilizing this service from WineChateau.com, the purchaser is representing that he/she is acting in a fashion compliant with his/her local and state laws regarding the purchase, transportation, and delivery of wine or spirits. By placing an order with WineChateau.com, purchaser authorizes WineChateau.com to act on buyer’s behalf to engage a common carrier to deliver buyer’s order. The purchaser represents that he/she has obtained all required permissions, paid all required fees, is working through properly licensed intermediaries, is legally entitled to take possession of wine & spirits, is legally entitled to take quantities ordered, and authorizes that he/she is 21 years of age or older. WineChateau.com makes no representation to the legal rights of anyone to ship or import alcoholic beverages into any state outside of New Jersey.

Limitation of Liability

IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN WINE CHATEAU’S TERMS OF SERVICE, IN NO EVENT WILL WE OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, ARISING OUT OF OR RELATED TO STEWARDSHIP. OUR TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE LAST ANNUAL MEMBERSHIP FEE YOU PAID. THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR MEMBERSHIP. CERTAIN STATE LAWS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

Fees; Renewal

The annual membership fee for Rewards Pass is $97.00. This fee is non-refundable except as expressly set forth in these Terms. Taxes may apply on either or both of the membership fee and the reduced shipping charges for Rewards Pass and you are responsible to pay all such taxes. UNLESS YOU NOTIFY US BEFORE RENEWAL THAT YOU WANT TO CANCEL, YOU UNDERSTAND YOUR MEMBERSHIP WILL AUTOMATICALLY RENEW AND YOU AUTHORIZE US TO COLLECT THE THEN-APPLICABLE ANNUAL MEMBERSHIP FEE AND ANY TAXES, USING ANY PAYMENT METHOD WE HAVE ON RECORD FOR YOU, AND TO CHARGE ANY CREDIT CARD, DEBIT CARD, OR ANY OTHER PAYMENT METHOD THAT WE HAVE ON FILE FOR YOU ONE OR MORE TIMES, FOR FULL OR PARTIAL AMOUNTS, AS REASONABLY NECESSARY FOR US TO COLLECT THE PAYMENTS DUE FROM YOU.

Membership Cancellation

You may cancel the renewal of your Rewards Pass membership at any time, and you will be eligible to the remaining number of days left on your yearly membership timeframe should you decide to order.  You must execute the full 365 day term with no additional charges to you because you cancelled the renewal of it.  By cancelling the membership you are notifying WineChateau.com that you do not wish to renew for the following year.
